MEMPHIS, Tenn. — For the second time in three months, an ouster has been filed to remove Shelby County Clerk, Wanda Halbert, from office.

A petition was submitted by attorney Robert D. Meyers on behalf of the Shelby County Attorney’s office for Halbert’s removal on Friday, citing that she “knowingly or willfully neglected and failed to perform one or more duties, responsibilities or obligations enjoined upon the Shelby County Clerk by the laws of the State of Tennessee.” pursuant to Title 8, Chapter 47 of the Tennessee Code Anointed.

Also in the petition, the Attorney’s office requested that the Circuit court suspend Halbert from performing any of the duties of her office pending a final hearing and determination of this matter by the Circuit court.

In May, WREG reported that the first petition had been filed for Halbert’s removal from office.

The document was filed on May 6 by Hamilton County District Attorney Coty Wamp and cited “willful neglect to perform a duty” and “Inaccurate and Untimely Financial Reporting” as the reasons for removal.

On June 18, a judge dismissed the effort to remove Halbert, ruling that Wamp did not have jurisdiction.

“We’re obviously disappointed in the outcome,” Wamp said in a press conference after the ruling. “All we can hope, maybe, is that someone else will pick it up. If they don’t, it may be a long two years.”

Halbert has 20 days to respond to the latest ouster petition.
