Recused judge in Tyre Nichols case could face deposition

MEMPHIS, Tenn. — The attorney for Justin Smith, one of the former officers convicted in Tyre Nichols’ deadly police beating, asked for the court’s guidance during a status conference in federal court on Wednesday.

Attorney Martin Zummach asked how to file a motion to depose or take statements from U.S. District Judge Mark Norris following his decision to recuse himself from the case.


“As far as reasons behind his recusal, that is under seal right now. I can tell you Judge Norris is acting in accordance with the law. This is unusual,” said Blake Ballin, defense attorney for Desmond Mills.

Judge Norris didn’t give a reason as to why he decided to remove himself earlier this month or why he did it just days before sentencing was slated to start.

Now, there are talks that Judge Norris could be questioned regarding that surprise decision.

During a deposition, a person is formally questioned under oath, outside a courtroom.
