MEMPHIS, Tenn. — A new judge is on the federal case for the five former officers convicted in Tyre Nichols’ deadly police beating; however, a new sentencing date has still not been set.
It’s been a week since Judge Mark Norris recused himself just days before he was scheduled to sentence some of the defendants.
Judge Norris has been replaced by U.S. District Judge Sheryl Lipman.
On Friday, the federal court was in session to discuss the status of the Tyre Nichols case.
Nichols’ mother, sister, and stepfather sat beside each other in the courtroom.
Demetrius Haley and Emmitt Martin both appeared in court in blue inmate jumpsuits, while Taderrius Bean sat beside his attorneys in a grey suit.
Haley, Bean, and Justin Smith were supposed to be sentenced this week, while sentencing hearings for Martin and Desmond Mills were scheduled for a later time.
However, that all changed when U.S. District Judge Mark Norris recused himself, without explanation.
While it may take Judge Lipman some time to familiarize herself with the case, during Friday’s hearing, she said she wants to get the case moving.
“She is always prepared. She’s very prepared; she’s going to read every line of every motion. And so, she’s also going to read every line of the transcripts,” said John Keith Perry, Jr., Taderrius Bean’s attorney. “The information in the case is voluminous. If it was on this sidewalk, it’d probably spread out from here in boxes to across the street and back.”
Defense attorneys have also filed motions or plan to file motions that call for a new trial or for the government to release more information about the case.
“Judge will read the motions. She’s got to familiarize herself with her transcript, and after that, we’ll see what she’s going,” said Attorney Perry.
A report date about the motions and next steps in the case is scheduled for July 24.
