MEMPHIS, Tenn. — The petition filed by the state to remove Shelby County Clerk Wanda Halbert from office this week is making its way through the courts. In four days, the case has already been assigned to two different judges.
According to documents from the Shelby County Circuit Court, Halbert was summoned on Monday when the state filed a petition to have her removed from office. The next day, Judge Cedrick Wooten asked to be recused.
On Wednesday, Halbert’s case was transferred to another judge.
“Wanda Halbert will have her day in court. She is entitled to a jury trial as it relates to her ouster proceedings,” Senator Brent Taylor said. “Although this is a jury trial it is not a criminal charge.”
Taylor says this has been a long time coming after years of complaints from residents and other elected officials.
Hamilton County DA completed an investigation and filed a petition Monday for the court to hold a hearing and suspend Halbert within the next five days. That five-day window ends this Friday.
WREG has reached out multiple times this week with no response from Halbert. She spoke with WREG after the County’s budget meeting last week.
“The bottom line is we don’t have the resources to do the job the way it needs to be done,” Halbert said.
As Friday nears, a possible suspension and removal are still in progress.
